TERMS AND CONDITIONS
ARTICLE 1. ACCEPTANCE
The customer acknowledges having read, at the time of placing the order, the special conditions of sale below and expressly declares to accept them without reservation. These General Conditions of Sale govern contractual relations between HELIDIGITAL and its client. They apply in particular to the conditions of ordering, payment, delivery and management of any product returns ordered by customers. These general conditions apply to all new goods and services sold through the website www.helidigital-bzh.com, and come into force from the signature or validation of the order form, which serves as electronic signature.
ARTICLE 2. PRODUCTS
Photographs and texts describing the products are not part of the contractual scope. In the event that errors are inserted, HELIDIGITAL cannot be held liable for them. Furthermore, the customer always has the possibility of contacting us to obtain additional information on the products presented via our contact form. The availability in stock of the products indicated on the site is only indicative. In the event of an exceptional and temporary stock shortage, particularly due to our suppliers, the customer will be informed as soon as possible and may cancel their order. The customer may then request either a refund of the sums paid within 30 days of payment at the latest, or an exchange of the product.
ARTICLE 3. ORDER
All orders must be made via the website www.heligital-bzh.com. An acknowledgment of receipt confirming that your order has been processed will automatically be sent to you by e-mail. HELIDIGITAL reserves the right to cancel any order from a customer with whom there is a dispute relating to the payment of a previous order. All information provided by the purchasing customer at the time of placing the order is binding on the latter. HELIDIGITAL cannot be held responsible for the consequences in the event of errors relating to the wording of the contact details of the recipient or debtor of the order.
ARTICLE 4. PAYMENT
4.1 General
The price of the items is payable in cash in Euros, on the day the order is placed. The order validated by the customer will be considered effective when the authorized bank payment centers have transmitted their acceptance. If these centers refuse, the order will be canceled. The products shipped remain the property of HELIDIGITAL until full payment has been made.
4.2 Online payment
- Bank card
The customer's banking information (bank card number and expiry date) is encrypted by the SSL system and then processed by our financial partner. Therefore, paying for a purchase at HELIDIGITAL does not involve any risk.
- PayPal platform
The customer will be automatically redirected to the secure PayPal site.
4.3 Other payment methods
- Bank check or postal order (France only) The item(s) ordered are only reserved and prepared upon receipt of the check.

ARTICLE 5. PRICES AND INVOICES
The prices indicated in the order confirmation by the company HELIDIGITAL include the prices of the products expressed in Euros as well as packaging, handling and transport costs. For member countries of the European Union, all services are sold including VAT, applicable on the day of the order. For countries outside the European Union, sales are made excluding VAT. The invoice is published by the HELIDIGITAL company and can be downloaded in PDF version directly from the customer account.
ARTICLE 6. DELIVERY
The delivery time depends on the actual availability of the products when ordering.
An order is considered capable of being shipped from the moment all the selected products are clearly displayed "in stock". If one of them is not indicated in stock, the customer will have to take into account an additional supply time. We do not carry out partial shipments since the calculation of shipping costs is made on the basis of a single shipment. If, however, the customer wishes to accelerate delivery by sending a partial shipment of his order, he must request this and pay additional shipping and packaging costs.
Delivery of our products is possible in all countries served by our transport partners. The products are delivered to the delivery address indicated by the customer on the order form. If the customer is absent and the shipment is countersigned, a delivery notice from the carrier will be sent to the mailbox, thus to subsequently reorganize the delivery of the package, or to collect it from the post office on closer.
Any delays cannot entitle the buyer to seek damages from HELIDIGITAL, unless the signature and insurance option is chosen. The goods always travel at the risk of the recipient. The customer is required to carefully check their packages upon arrival upon delivery. In the event of a package being returned to our premises due to non-collection, our customer service will contact you to make the necessary arrangements for reimbursement or reshipment. In any case, reshipping costs will be the responsibility of the customer.
In the case of a package delivered in poor condition : the customer must refuse the package by indicating on the delivery slip the words "package refused because damaged" and immediately contact our services. If the package shows obvious traces of opening, shocks, and one or more item(s) is missing, you must also refuse it and make a report of theft to the carrier, which you will send back to us so that we can proceed. for refund or exchange.
If these procedures are not respected, HELIDIGITAL disclaims all responsibility for possible refunds of products and transport.
ARTICLE 7. OUR GUARANTEES
7.1 Secure payment
The security of your payments is our priority. All transactions carried out on the HELIDIGITAL website are 100% secure. Indeed, all personal data transmitted by our security server is locked before being transmitted over the Internet.
7.2 Damaged item or non-conformity of the delivered good
Although we take the greatest care in the selection and packaging of your products, we are never safe from an error or incident. In this case, you have 14 days to report the incident to us via our contact form.
7.3 Right of withdrawal
In accordance with the provisions of article L.121-16 of the Consumer Code, you have 14 days to change your mind. The item(s) must be returned in the original packaging accompanied by all related documents (notes, warranty, invoice, etc.).
In this case, packaging and shipping costs will be borne by the customer. In the event of exercising the right of withdrawal, HELIDIGITAL undertakes to reimburse the item(s) returned in the form of a credit (to be used on the site for a future order) or in the form of a refund. (to be specified), upon receipt of the returned product(s).
7.3.1 How to exercise your “right of withdrawal” guarantee ?
It is imperative to respect the withdrawal period of 14 days : the period runs from the day of receipt of the goods according to the tracking of the package, and until the shipping date indicated on the return package. To exercise this right, after contacting our services, return the item(s) in the original packaging, intact, attaching any accessories, instructions for use and a photocopy of the invoice with the reason. of the product return(s).
7.3.2 Protection of goods in the event of returns
HELIDIGITAL strives to provide the best care for the protection and packaging of delivered products. In the event of returning goods, the same care is required of the customer, so that they reach us without damage. If it is noted and demonstrated by HELIDIGITAL that one or more returned item(s) is damaged, this cannot be the subject of a credit note. In the event of partial breakage, the credit will be made in proportion to the number of products received in good condition.
ARTICLE 8. WARRANTY AND AFTER-SALES SERVICE
All our products benefit from the supplier's guarantee. The terms and duration of the warranty are specific to each product. For any further information, contact us.
Any after-sales service return request must first be reported to HELIDIGITAL, and accepted by our services which will then provide a returns number.
In addition, in order to properly process your request, a copy of the invoice must be attached to the return. Shipping costs incurred for returning the product are the responsibility of the customer. Return costs after repair or exchange are the responsibility of the customer.
ARTICLE 9. LIABILITY
Damage caused by marketed products : HELIDIGITAL cannot be held responsible for damage of any nature, whether material, immaterial or bodily, which could result from malfunction or misuse of the marketed products. HELIDIGITAL not being a manufacturer, only the liability of the manufacturer of the incriminated product can be sought by the customer.
ARTICLE 10. APPLICABLE LAW – JURISDICTION
Any disputes that arise as a result of or in connection with this contract may be submitted to the competent mediation and arbitration center for assessment. In the event that mediation is not successful, the disputes will fall under the jurisdiction of the Saint Malo Commercial Court.
ARTICLE 11. RESPECT FOR IDENTITY
11.1 Processing of personal information
The provision of personal information collected for the purposes of distance selling is mandatory. This information is essential for the processing and delivery of orders and invoices. In accordance with the “Informatique et Libertés” law, the processing of personal information relating to HELIDIGITAL customers has been declared to the Commission Nationale de l’Informatique et des Libertés (CNIL) under the registration number No. 1421075.
11.2 Right of access, modification, rectification and deletion
